§ 42-2. Smoking in public buildings.

  • (a)

    It shall be unlawful for any person to smoke or ignite any cigarette, pipe, cigar, tobacco or any other substance in any public building or building open to the public in areas posted and designated that prohibit smoking.

    (b)

    In buildings or portions of buildings where smoking is prohibited, signs indicating the areas where smoking is prohibited shall be posted in a conspicuous place, readily visible to all persons who enter such area or building.

    (c)

    Ash trays shall be made available at the entrance to buildings or areas where smoking is prohibited.

    (d)

    It shall be unlawful for any person to remove, deface, alter, obscure from view or damage any sign designating the prohibiting of smoking in any building or a portion thereof or any prohibited area.
