§ 130-264. Duties of city officials.

  • The director of engineering or designee is hereby appointed to administer and implement this article and other appropriate sections of 44 CFR (Emergency Management and Assistance National Flood Insurance Program Regulations) pertaining to floodplain management. The duties of the director of engineering shall include, but not be limited to:

    (1)

    Reviewing and approving or disapproving all development permits to determine that the permit requirements of this article have been met and that all necessary, local, state, and federal permits have been obtained;

    (2)

    Submitting and enacting the components of the municipal stormwater management program as required by TCEQ;

    (3)

    Obtaining and recording the actual elevation in relation to mean sea level of the finished pad for all new residential or commercial building sites;

    (4)

    Maintaining for public inspection all records pertaining to the provisions of this article, including floodproofing certifications;

    (5)

    Notifying adjacent communities and the state coordinating agency, the Texas Water Development Board (TWDB), and also the Texas Commission on Environmental Quality (TCEQ) prior to any alteration or relocation of a watercourse and submitting evidence of such notification to FEMA;

    (6)

    Requiring that maintenance is provided within the altered or relocated portion of said watercourse so that the flood-carrying capacity is not diminished;

    (7)

    Making interpretations, where needed, as to the exact location of the boundaries of the areas of special flood hazard, for example, where there appears to be a conflict between a mapped boundary and actual field conditions;

    (8)

    Obtaining, reviewing, and reasonably utilizing any base flood elevation data available from a federal, state, or other source in order to administer this article when base flood elevation data has not been provided;

    (9)

    Inspecting sites to determine compliance with the erosion control guidelines; and

    (10)

    Reviewing and allowing any appropriate modifications to the residential lot drainage requirements.
